1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern your access to and use of southcoastwindowsanddoors.com (the “Site”), operated by South Coast Windows & Doors (“SCWD,” “we,” “us,” or “our”). By accessing or using the Site — including submitting a contact form, requesting an estimate, or browsing our content — you agree to be bound by these Terms. If you do not agree, please do not use the Site.
These Terms govern use of the website only. They do not constitute, and are not a substitute for, the written proposal, contract, or work order you sign with us for any window, door, or siding installation project. In the event of any conflict between these Terms and a signed project contract, the signed contract controls for matters relating to that project.
2. Use of the Site
You agree to use the Site only for lawful purposes and in a manner consistent with its intended purpose of learning about our products and services and requesting estimates. You agree not to:
- Submit false, misleading, or fraudulent information through any form on the Site;
- Attempt to gain unauthorized access to any part of the Site, our systems, or networks;
- Interfere with or disrupt the Site’s operation, including through malware, scraping, or automated bots;
- Use the Site to transmit unlawful, harassing, or infringing content; or
- Copy, reproduce, or resell Site content for commercial purposes without our written permission.
3. Estimates, Quotes & Contracts
Any pricing, timelines, or product information presented on the Site (including on product/category pages) is provided for general informational purposes only and does not constitute a binding offer or quote. Actual pricing, materials, timelines, and scope of work are determined only through an in-home consultation and a written, signed proposal or contract.
No contract for goods or services is formed between you and SCWD until both parties have signed a written project agreement. Submitting a request for an estimate through the Site does not obligate either party to proceed with any project.
Note: California law (Business & Professions Code and CSLB regulations) requires specific disclosures, a 3-day right of rescission on certain home-improvement contracts, and other consumer protections in the written contract for your project — these Terms do not replace or limit those statutory rights, which will be set out fully in your signed agreement.
4. Contractor License Disclosure
South Coast Windows & Doors is a licensed, bonded, and insured contractor. California Contractors State License Board (CSLB) License #1092996. You may verify our license status at cslb.ca.gov.
5. Intellectual Property
All content on the Site — including text, graphics, logos, photographs, product descriptions, and page design — is owned by SCWD or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. Manufacturer names, logos, and product images (e.g., Milgard, Ply Gem, Quaker, Kawneer, Western Window Systems, C.R. Laurence (CRL), and others referenced on the Site) are trademarks of their respective owners and are used to describe products we sell and install, not to imply endorsement unless stated.
You may view and print pages of the Site for your own personal, non-commercial use in evaluating our services. No other use, including reproduction, distribution, or creation of derivative works, is permitted without our prior written consent.
6. Accessibility (UserWay)
We are committed to making the Site accessible to all users, including individuals with disabilities, and aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. We use the UserWay accessibility widget to provide on-screen tools such as text resizing, contrast adjustment, and screen-reader compatibility enhancements.
While we strive for full accessibility, no automated tool can guarantee full compliance on every page at all times. If you encounter any barrier while using the Site or need assistance in an alternate format, please contact us using the information in Section 15 and we will make reasonable efforts to address it promptly.
7. Disclaimer of Warranties
THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that any information on the Site (including pricing, specifications, or availability) is complete, accurate, or current.
Warranties on installed products and workmanship (such as manufacturer warranties or our own workmanship warranty) are governed exclusively by the terms provided in your signed project contract and applicable manufacturer warranty documentation — not by this Site.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SOUTH COAST WINDOWS & DOORS, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability arising out of or relating to your use of the Site shall not exceed one hundred dollars ($100). This limitation does not apply to liability arising from a separately signed installation contract, which is governed by its own terms, or to liability that cannot be limited or excluded under applicable law.
9. Indemnification
You agree to indemnify, defend, and hold harmless South Coast Windows & Doors and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any rights of a third party.
10. Third-Party Links & Materials
The Site may contain links to third-party websites (including manufacturer sites, review platforms, and social media) for your convenience. We do not control and are not responsible for the content, accuracy, or practices of any third-party site. Inclusion of a link does not imply our endorsement of that site.
11. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect information submitted through the Site, and is incorporated into these Terms by reference.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction and venue there.
This provision governs disputes about the website only. Disputes arising from an installation project are governed by the dispute resolution provisions (which may include mediation or arbitration) contained in your signed project contract.
13. Changes to These Terms
We may revise these Terms at any time by updating this page. The “Last updated” date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
14. Severability & Waiver
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
